We sell original artworks, limited editions and prints, digital products and courses, and may offer books and merchandise fulfilled by third-party partners.

2. Scope and acceptance

By using the site or placing an order you agree to these Terms and Conditions and to the policies linked in the footer. If you do not agree, please do not use the site.

3. Products and availability

We aim to describe sizes, media, editions, and materials accurately. Screen colours may vary. Editions can sell out. We may update prices, availability, or details at any time.

4. Prices, taxes, currency

All prices are shown in euros (EUR) and include taxes where applicable. Shipping, insurance, and import duties are shown or advised before payment. If duties or local taxes apply in your country, you are responsible for paying them.

5. Payment

Payment is processed securely by Stripe or any other processor we enable. You agree to provide accurate billing and contact details. Orders are confirmed only after successful payment authorisation.

6. Order process and contract

Your order is an offer to purchase. We will email an order confirmation. The contract is formed when we accept and confirm dispatch or, for digital items and commissions, when we accept your order in writing.

7. Shipping, collection, and risk

  • If we arrange shipping: risk transfers to you on delivery to your address.

  • If you arrange shipping or nominate your own carrier: risk transfers to you on handover to your carrier at the agreed drop-off point. We will provide reasonable proof of handover.

  • We pack professionally. Please inspect on delivery and note any visible damage with the carrier at the time of receipt.

  • Delivery times are estimates. We are not liable for delays outside our control.

  • If a parcel is returned due to an incorrect or incomplete address supplied by you, re-shipping costs may apply.

8. Third-party fulfillment for books and merchandise

Some items such as books or merchandise may be produced and shipped by a third-party fulfillment partner.

  • Your contract remains with Tereza Barnard Studio SL.

  • Dispatch times, packaging, and tracking are managed by the partner.

  • Quality issues or damage in transit should be reported to us with photos within 7 days of delivery so we can investigate and arrange a remedy according to these terms and applicable law.

  • Return addresses may differ from our registered address and will be provided in return instructions.

9. Right of withdrawal for consumers in the EU and EEA

If you are a consumer purchasing at a distance you have a legal right to withdraw from most purchases within 14 calendar days without giving a reason.

  • Goods: the 14 days run from the day you receive the item.

  • How to withdraw: email a clear statement to studio@terezabarnard.com within the 14 days. You may use the model form in section 10.

  • Returns: send the goods back within 14 days of telling us you are withdrawing. You are responsible for return shipping costs and insurance, unless we failed to inform you of these costs in advance.

  • Refunds: we refund the price paid, including our standard outbound shipping if applicable, within 14 days of the earlier of: receipt of the goods or proof of return shipment. We may deduct any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Legal exceptions to withdrawal

You do not have a right to withdraw from:

  • Custom or personalised works and commissions created to your specifications.

  • Digital content supplied by download or streaming after you have expressly requested immediate supply and acknowledged you lose your right to withdraw once access begins.

  • Services fully performed within the 14-day period after you expressly requested performance.

  • Sealed items not suitable for return for health or hygiene reasons once unsealed.

11. Returns procedure and condition of items

Return the work in its original packaging where possible, or equivalent professional packaging, with full insurance. You are responsible for any loss or damage during return transit. We may reduce the refund to reflect any diminished value.

12. Digital products, courses, and downloads

Digital items and courses are for personal use only. Sharing, reselling, or redistributing is not permitted. Where you consent to immediate access, you acknowledge that you lose the statutory 14-day withdrawal right once access begins.

13. Gift cards and vouchers

Unless required by law, gift cards are non-refundable and cannot be exchanged for cash. Validity periods, if any, are stated at purchase.

14. Reviews and user content

If you post reviews or comments, you must own the content and keep it lawful, accurate, and respectful. We may remove content that breaches these terms.

15. Intellectual property

All artworks, images, text, designs, and branding are protected by copyright and other rights. No reproduction or commercial use is permitted without written permission.

16. Warranty and conformity

If a product is defective or not as described, EU consumer rules on lack of conformity apply. Contact us promptly with photos and details so we can repair, replace, or refund as required by law.

17. Liability

We are not liable for loss not caused by our breach or negligence, or for business losses such as loss of profit, revenue, or opportunity. Nothing limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law.

18. Privacy and cookies

Your personal data is processed according to our Privacy Policy and Cookie Policy. The cookie tool lets you accept, reject, or change preferences at any time.

19. Complaints and ODR

20. Governing law and jurisdiction

These terms are governed by Spanish law. The courts of Palma de Mallorca have non-exclusive jurisdiction. Consumers may also bring claims in the courts of their habitual residence in the EU.

21. Changes to these terms

We may update these terms. The version posted on the site at the time of your order applies to that order.
